Nevada Overtime Rules
Nevada has a unique wage-conditional daily overtime rule. Under NRS 608.018:
- Employees earning less than 1.5 times the state minimum wage must be paid 1.5× for all hours over 8 in a workday
- Employees earning 1.5 times the minimum wage or more are subject only to the federal 40-hour weekly overtime rule
- The federal 40-hour weekly rule applies to all non-exempt employees regardless of hourly rate

The Wage Threshold
With Nevada's minimum wage at $12.00/hr, the daily OT threshold is $18.00/hr (1.5 × $12.00). Workers earning $18.00/hr or more only get weekly OT after 40 hours. Workers earning less than $18.00/hr get daily OT after 8 hours in addition to weekly OT.
Note: The minimum wage is adjusted periodically. Check the Nevada Labor Commissioner for the current rate.
Frequently Asked Questions
I earn $20/hour. Do I get daily overtime in Nevada?
No. At $20/hr, you are above the 1.5× minimum wage threshold ($18.00/hr). You only qualify for weekly overtime after 40 hours in a workweek.
Does Nevada have double time?
No. Nevada does not require double time. Only time-and-a-half (1.5×) applies.
What if I work both daily and weekly overtime hours?
Hours already counted as daily overtime reduce the regular hours counted toward the weekly 40-hour threshold. You receive whichever calculation results in greater total pay.
